Kuwboo Terms of Service

Welcome to Kuwboo. These Terms are a contract between you and Guess This Ltd, a company registered in the United Kingdom ("we", "us", "our"). They apply whenever you use the Kuwboo mobile app, website, or any related services (together, the "Service").

Please read these Terms together with our Privacy Policy. By creating an account or using the Service, you agree to them.

1. Acceptance of these terms

By tapping "Create account", signing in with Apple or Google, or otherwise using the Service, you confirm you have read and agree to these Terms. If you don't agree, don't use the Service.

2. Eligibility and age

• You must be at least 13 years old to create a Kuwboo account. Some features (dating, marketplace sales, direct messaging with adults) require you to be 18 or older.
• If you are under 18, you confirm that a parent or legal guardian has reviewed these Terms and consents to your use.
• You must have the legal capacity to enter into a binding contract where you live.
• We use age assurance signals as required by the UK Online Safety Act and the ICO Age Appropriate Design Code. If we believe you have misrepresented your age, we may suspend or close your account.

3. Your account

• Provide accurate information when you sign up, and keep it up to date.
• Keep your credentials safe. You are responsible for activity on your account.
• Don't share, sell, rent, or transfer your account.
• One account per person. We may restrict or remove duplicate or ban-evasion accounts.
• You can delete your account at any time — see Delete your account.

4. Acceptable use

When using Kuwboo, you agree not to:

• Break the law, or help anyone else break the law.
• Post content that is illegal, threatening, harassing, defamatory, hateful, sexually exploitative, or that promotes violence.
• Share child sexual abuse material (CSAM) or any content that sexualises minors. We report this to law enforcement without warning.
• Impersonate anyone, misrepresent your identity, or create fake profiles.
• Spam, phish, scam, or run pyramid/Ponzi schemes.
• Scrape, crawl, or otherwise automate access to the Service without our written permission.
• Reverse-engineer, decompile, or circumvent security features.
• Interfere with other users' access to the Service (for example, by abusing the reporting system).
• Use the Service to stalk, harass, or intimidate anyone.
• Sell prohibited items (see Marketplace Rules below).

5. Your content

You keep ownership of the content you post. By posting, you grant Guess This Ltd a worldwide, non-exclusive, royalty-free licence to host, store, cache, display, reproduce, adapt, publish, and distribute that content for the limited purpose of operating, promoting, and improving the Service. This licence ends when you or we remove the content, except for copies that must be retained for legal or moderation reasons, or that other users have saved to their own devices.

You confirm that any content you post:

• is yours, or you have permission to post it;
• doesn't infringe anyone else's intellectual property, privacy, or publicity rights;
• complies with Section 4 (Acceptable use).

We may remove content that breaks these Terms, and we may preserve content to comply with legal requests.

6. Marketplace rules

Kuwboo includes a marketplace module for buying and selling items between users. Specific rules:

• Sellers: describe items accurately, honour your listings, respond to buyers in good faith, comply with UK consumer-protection law (including distance-selling, where it applies). Don't list counterfeit goods, stolen property, weapons, controlled drugs, live animals, human remains, adult/explicit items, or anything that requires a licence you don't hold.
• Buyers: pay on time, communicate promptly, follow the dispute process before leaving negative reviews.
• Payments: handled by a PCI-compliant payment processor. Kuwboo is not a bank and doesn't hold funds on your behalf. All transactions are between buyer and seller; we facilitate but are not a party to the sale unless expressly stated.
• Disputes: use the in-app dispute flow first. We may mediate, issue refunds, and adjust account standing based on evidence. Our decision is final for platform-level disputes; you retain any rights you have under applicable law (e.g., chargeback through your card issuer).
• Taxes: you are responsible for your own taxes on marketplace income.

7. Dating module safety

The dating module carries real-world risk. You agree to:

• Meet new matches in public places; tell a friend where you're going.
• Never send money, crypto, gift cards, or banking information to someone you've only met on Kuwboo.
• Use the in-app reporting tool if anyone asks you to do the above, sends explicit content without consent, or makes you feel unsafe.

We comply with US state dating-app safety laws where they apply and surface safety messaging accordingly. Guess This Ltd is not liable for the behaviour of other users off-platform. See Section 11 (Disclaimers).

8. Moderation and enforcement

We use automated moderation and human review to keep Kuwboo safe. Possible actions for breaching these Terms:

• Content removal
• Feature restrictions (for example, disabling marketplace or dating)
• Temporary suspension
• Permanent termination of your account
• Reporting to law enforcement for illegal conduct

If your account is actioned and you believe it's a mistake, you can appeal via the in-app flow or by emailing the address in Section 16.

9. Intellectual property and DMCA

The Kuwboo name, logo, UI, code, and content we create are ours or licensed to us. You may not use them without written permission, except as needed to use the Service normally.

If you are a rights holder and you believe content on Kuwboo infringes your copyright, send a DMCA-compliant notice to neildouglas33@hotmail.co.uk with subject line "DMCA". Include:

• Identification of the copyrighted work;
• Identification of the infringing material and its location on Kuwboo;
• Your contact information;
• A statement that you have a good-faith belief the use is not authorised;
• A statement under penalty of perjury that the notice is accurate and you are the rights holder or authorised to act for them;
• Your physical or electronic signature.

We respond to counter-notices in the same manner.

10. Termination

You can stop using Kuwboo at any time and delete your account as described in our Delete Account page. We can suspend or terminate your account, with or without notice, if you breach these Terms or if we need to protect the Service, our users, or comply with the law. Sections 5 (licence for retained content), 9 (DMCA), 11–14 (disclaimers, liability, indemnity, disputes), and 16 (contact) survive termination.

11. Disclaimers

Kuwboo is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Service will be uninterrupted, error-free, or secure, or that defects will be corrected.

We are not responsible for the content, actions, or omissions of other users — including off-platform meetings, marketplace transactions, or private messages between users. We do not verify the identity of users beyond the mechanisms described in our Privacy Policy and these Terms.

12. Limitation of liability

To the fullest extent permitted by law, Guess This Ltd, its directors, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising from or related to your use of the Service, even if we have been advised of the possibility.

Our total cumulative liability to you for any claim arising from or related to these Terms or the Service is limited to the greater of (a) the amount you have paid us in the 12 months before the claim, or (b) GBP 100.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation. If you are a consumer in the UK or EU, your statutory rights are not affected.

13. Indemnity

You agree to indemnify and hold Guess This Ltd harmless from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your breach of these Terms, or your violation of another person's rights.

14. Governing law and disputes

These Terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales, unless you are a consumer and applicable law gives you the right to bring a claim where you live. Nothing here removes that right.

We encourage you to contact us first at the email below — most issues can be resolved quickly without lawyers.

15. Changes to these terms

We may update these Terms. If a change materially affects your rights, we'll notify you in the app and by email at least 14 days before the change takes effect. Your continued use of Kuwboo after the effective date means you accept the new Terms. If you don't agree, stop using the Service and delete your account.
